Terms of Service

These terms govern your use of Bayena, a website design and management service operated by XAds LLC. By purchasing or using the service, you agree to them.

The service

Bayena builds, hosts, and manages a professional website for your business. The service consists of a one-time build fee and an ongoing monthly service fee, both quoted to you in writing before you pay. The monthly service includes hosting, security, your domain, content changes requested by text, and a monthly performance report. Your monthly subscription begins when your website goes live.

Free preview

Website previews are free and carry no obligation. Previews are our property until you purchase; after purchase, the finished website content we create for you is yours.

48-hour guarantee

If your website is not live within 48 hours of payment and receipt of the information we need from you (excluding delays outside our control, such as domain transfers you manage), we will credit $500 toward your build fee.

Your domain

Your domain name is registered in your name or transferred to you. If you cancel, you keep your domain.

Cancellation

There is no contract. You may cancel the monthly service at any time by texting us; service continues through the end of the current billing period. Build fees are non-refundable once your website is live.

Your content

You confirm you have the right to use any content you send us (photos, logos, text) and that it is accurate. We may decline content that is unlawful or misleading.

Limitation of liability

The service is provided "as is." To the maximum extent permitted by law, XAds LLC's total liability for any claim related to the service is limited to the amounts you paid us in the twelve months before the claim.
